Terms of service

These terms are an agreement between you and Market Me LLC, a California limited liability company, which operates MyWholeFile MD. By using the service you agree to them. If you do not agree, do not use the service.

1. What the service does

MyWholeFile MD retrieves copies of your health records from clinicians you authorize, organizes them into a single record with the source of each item preserved, and allows you to review that record and, at your option, connect an AI assistant that can read the categories you approve.

The service is offered through participating clinical practices. Your access may depend on your relationship with the practice through which you enrolled.

2. Not medical advice

MyWholeFile MD does not provide medical advice, diagnosis, or treatment, and does not practice medicine. It helps you read information your clinicians recorded. Nothing in the service, including any summary or explanation generated with the help of artificial intelligence, is a substitute for the judgment of a qualified clinician who knows you.

Never disregard professional medical advice or delay seeking it because of something you read here. If you think you may be having a medical emergency, call 911 or go to the nearest emergency department. The service is not monitored and must never be used to report an emergency or to communicate anything urgent to your clinician.

3. Accuracy and completeness

We present records as your clinicians recorded them. We do not verify, correct, or complete them, and we cannot. Your record here may be incomplete because a practice you have seen is not connected, because a practice does not publish a category of information, or because a source system was unavailable. Treat what you see as a copy of part of your record, never as the whole of it.

Where AI-generated summaries appear, they may contain errors. Answers cite the underlying records precisely so that you and your clinician can check them, and you should check anything you intend to act on.

4. Read-only access

The service cannot write to your medical record, place orders, request prescriptions or refills, schedule appointments, or send messages to your clinician on your behalf. Do not attempt to use it for any of these purposes.

5. Your account

You must be 18 or older, or enrolled by a practice with the consent of your legally authorized representative. You agree to provide accurate information, to keep your credentials secure, to enable the authentication factors we require, and to tell us promptly at security@mywholefilemd.com if you believe your account has been compromised.

You may only connect records that are your own or that you are legally authorized to access.

6. Connecting an AI assistant

Connecting an assistant is optional and off by default. It causes your health information to be transmitted to a third-party company that is not bound by our agreements and not covered by HIPAA. You direct that disclosure; we execute it on your instruction. Your use of any assistant is governed by that provider’s terms, and we are not responsible for how they handle, retain, or use what you send them.

Your practice may choose not to make this pathway available. Read the AI sharing disclosure before connecting anything.

7. Acceptable use

You agree not to:

• Access, or attempt to access, records belonging to anyone you are not authorized to represent
• Probe, scan, or test the security of the service except as invited by our security page
• Interfere with the service or with the source systems it connects to, including by automated scraping or excessive request volume
• Reverse engineer the service, except where that restriction is unenforceable by law
• Use the service to violate any law or anyone else’s rights

8. Privacy

Our privacy policy describes how we handle information and forms part of these terms. We operate as the Business Associate of the practice through which you enrolled, and we handle protected health information under a written agreement with them.

9. Intellectual property

Your health information is yours. We claim no ownership of it and no license to it beyond what is necessary to operate the service for you and to carry out instructions you give us. We do not use it to train artificial intelligence models and do not sell it.

The software, design, and brand of MyWholeFile MD belong to Market Me LLC.

10. Availability

We do not guarantee uninterrupted availability. The service depends on third-party health record systems that we do not control and that may change, restrict, or withdraw access. We may modify or discontinue features. If we discontinue the service, we will give you reasonable notice and an opportunity to export your data.

11. Termination

You may stop using the service and delete your account at any time; see export and deletion. We may suspend or terminate an account that violates these terms, that poses a security risk, or when the practice through which you enrolled ends its relationship with us. Where we terminate, we will give you an opportunity to export your data unless doing so would create a security or legal risk.

12. Disclaimers

Except where the law does not allow it, the service is provided “as is” without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that your record is complete, accurate, or current, because we do not create it.

13. Limitation of liability

To the maximum extent permitted by law, Market Me LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the service. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or one hundred United States dollars.

Nothing in these terms limits liability for gross negligence, willful misconduct, fraud, or anything else that cannot be limited by law.

14. Indemnity

You agree to indemnify Market Me LLC against claims arising from your misuse of the service, your violation of these terms, or your access to records you were not authorized to access.

15. Changes

We may update these terms. For material changes we will give notice before they take effect. Continuing to use the service after that means you accept the updated terms. If you do not accept them, stop using the service and delete your account.

16. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in Los Angeles County, California.
